Federal Court Orders Freedom of Abrego Garcia from Immigration Custody
A federal judge has ordered the immediate release of Kilmar Abrego Garcia from immigration custody, concluding his ongoing confinement lacks lawful basis.
"Since his return from wrongful detention in El Salvador, he has been re-detained, again without legal justification," Judge Paula Xinis wrote in her ruling.
The case stems from a mistaken deportation to El Salvador earlier this year, which the government later admitted was an mistake. Following his return to the United States to answer alien smuggling charges, he was held in immigration custody.
In her order, the court noted that the authorities lacks a current removal order, which effectively blocks them from removing Mr. Abrego Garcia "for now."
